Legal Analysis Related To Misuse of Gadget by Children

Abstract

The Corona Pandemic which happened universal including in Indonesia since 2020 has made big diffrences in the society and in people’s life. One of the fundamental changing that occurred is related to the increasing use of electronic devices for the last one year.Many government institution and privates institutions instructed their employees to work from home and almost all of the educational lines from PAUD, kindergarten, elementary school, junior high school, senior high school and also Universities were instructed to study or learnt from home. As the consequences of the work from home and study from home then there are the increasing of the electronical devicesor or we called it gadgets  to support those activities. This paper is conceptual paper which giving the analyse the sources of law related to the use of gadgets and the rules about children related to the legal fact about the misuse of those gadgets.. The result of this research shown that the misuse of gadget which has been done by the children unfortunately come to acts that can be categorized as crimes starting such as cyberbully, online gambling and also the act of porn action or pornography. But from the side of law enforcement we will see that there are some obstacles so that the enforcement of law can not be implimentate maximally,  such as the ages of those children which must be using the restorative jusctice as the law approach, the lack of limitation given by the government in accessing many contents in internet and also the lack of parental guidance in the use of gadget by their children in the time of corona pandemic.
